Plain-language terms that govern how organizations and people use TuffoNova. We try to keep them short, fair, and free of traps.
Terms of service
By creating an account or using TuffoNova on behalf of an organization, you agree to these terms.
1. The service
TuffoNova is a software-as-a-service platform that operates volleyball programs — tryouts, rosters, season management, stats, live match tracking, and tournament operations. Specific features available to your account depend on the plan tier you select.
2. Accounts
- You must be at least 13 to create your own account. Player records for athletes under 13 must be created or claimed by a verified parent or guardian, or by an organization with parental consent on file.
- You are responsible for keeping your credentials secure and for activity under your account.
- An organization admin may invite, promote, demote, or remove members of their organization. Admins are responsible for managing access and offboarding.
3. Acceptable use
Don’t do any of the following:
- Upload content you don’t have the right to upload.
- Harass, threaten, or share private information about minors or other users.
- Probe, scan, or attempt to break the security or rate-limits of the service.
- Use the service to violate any law — including COPPA, FERPA, and SafeSport requirements that apply to your program.
- Attempt to gain access to data belonging to organizations you are not a member of.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on severity.
4. Payments and trials
- The Free tier is free, subject to feature limits.
- Paid tiers are billed monthly or annually based on the plan you select. Annual plans receive the discounted rate listed on the pricing page.
- Tournament-tier transaction fees are deducted from registration revenue collected through the platform.
- Fees are non-refundable except where required by law or where we make a billing error.
- You can cancel a subscription at any time; your organization retains access through the end of the paid period.
5. Your content
You and your organization keep all rights to the rosters, stats, video markers, tournament records, and other content you put into TuffoNova. You grant us a limited license to host, copy, transmit, and display that content as needed to operate the service for your organization. We do not use customer content to train machine-learning models without explicit, separate written consent from the organization.
6. Privacy
Our handling of personal data is governed by the Privacy Notice, which is incorporated into these terms by reference.
7. Service availability
We work hard to keep TuffoNova available, but we do not promise zero downtime. Scheduled maintenance, third-party outages, and force majeure events can interrupt service. Enterprise customers may receive a written availability commitment in their order form.
8. Termination
You can stop using TuffoNova at any time. We can suspend or terminate accounts that violate these terms, that are materially overdue on payment, or that we are required by law to terminate. We’ll provide reasonable notice except where doing so would create harm.
On termination, organization admins may export data on a wind-down window described in the Privacy Notice.
9. Warranties and disclaimers
The service is provided on an “as is” basis. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to the service is limited to the fees you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, except where limitation of liability is prohibited by law.
11. Indemnification
You agree to defend and indemnify Tuffo, Inc. and its personnel against claims arising from your misuse of the service, your content, or your violation of these terms or applicable law.
12. Disputes and governing law
These terms are governed by the laws of the United States and the state listed in your order form (or, if none is listed, the state in which Tuffo, Inc. is incorporated), without regard to conflict-of-laws rules. The parties will first try in good faith to resolve any dispute through direct negotiation. If that fails, disputes will be resolved in the state or federal courts located in that jurisdiction, except where applicable law requires another forum.
13. Changes to these terms
We will update these terms as the platform grows. Material changes will be communicated by email to organization admins or posted in-app at least thirty days before they take effect, except for changes required by law or needed to protect users.
